Article 1
These Terms and Conditions of Sale exclusively govern the rights and obligations of the parties to sale via the website www.vintagetoysforboys.be.
The seller concerns Toys for Boys Brussels – Design Technics bv (VAT BE 0471.990.914), with registered office at 8800 Roeselare, Regina Wautersweg 9b, Belgium (hereinafter "Seller"). The person who wishes to purchase is further referred to as the "Customer" and together they are called the "Parties".
The Customer explicitly acknowledges and accepts these conditions.
Article 2
The Customer has a right to access, modify, correct and delete the data relating to the Customer according to the Data Protection Law (GDPR) by contacting the Seller.
Article 3
The price of each Product or service sold on the Site is displayed in Euros and the price is valid at the time of confirmation of the order. If VAT is charged, this is included in the price. The price does not include delivery or shipping costs, insurance, local taxes and duties,… which are always at the expense of the Customer. The delivery costs must be paid together with the sales price.
The Seller reserves the right to cancel any order, or to cancel delivery in the event of a dispute with the Customer, non-payment or reporting by the Bank, without any liability on the part of the Seller.
The Customer can cancel his order immediately after that order, as far as the payment has not yet been made.
Article 4
The goods which Vintage Toys for Boys has on offer are shown in images on the website. Slight deviations between what is depicted and actual characteristics do not represent any shortcomings on the part of the ordered product. There may, for instance, be differences in colour due to differing light conditions, specific camera positions or normal handling and warehouse storage.
Article 5
The display of the products in the online shop does not represent a legally binding offer but a non-binding online catalogue.
Whether the Seller accepts the order depends on the availability of the product. As many of the goods on offer in the online shop represent unique items, their availability cannot be guaranteed. The Seller will, as soon as he can process the order, let the Customer know if he cannot accept the Customer’s order 1) if objects are not available anymore, 2) or if objects are in option for a earlier party, 3) or if the Seller detects a major fault on the object at the moment of order picking, 4) or in case the Seller’s subdealer is not able to confirm availability.
If the Customer likes to place an order he is adviced to send an email to the Seller via info@vintagetoysforboys.be prior to the placing of the order so the Seller can assure availability.
Article 6
The Customer can pay via bank transfer payment in advance; Bank: KBC, Bank Code: KREDBEBB, IBAN: BE30 7360 0379 7111
The transfer of ownership takes place only after full receipt of the payment by the Seller.
Article 7
Depending on the specific nature or fragility of the object some items will only be available by simple pick up by the Customer (or transport responsible of the Customer) at the Seller’s address. All islands, as well as the states of Hawaii and Alaska in the United States, are excluded from our shipping; other exclusions from delivery for reasons as above-mentioned will be communicated.

In case of the delivery of the products done by the Seller the delivery will be done at the address stated by the Customer to the person present there. Then the risk transfer also occurs. In the event of absence, a message will be sent indicating the procedure for receipt.
Immediately after receipt, the Customer must check the products and formulate any complaints, for which he has an expiration period of 24 hours after delivery.
Article 8
In case of an online selling process without physical inspection of the product(s) at the Seller’s place prior to the purchase the Customer may inform the Seller that he renounces his purchase, without payment of a fine and without stating reasons, within a period of 14 days, counting from the day following the day of delivery of the product. From this notification, the Customer has a period of 10 days to return the product to the Seller. In the event of non-compliance with these terms, the Customer is deemed to permanently abandon his right of withdrawal.
The return to the Seller will be made to the following address: 8800 Roeselare, Regina Wautersweg 9b (Belgium).
In case of lawful exercise by the Customer (and the products are still in impeccable condition in original packaging) of his right of withdrawal, the Seller will refund the price paid by the Customer (excluding delivery costs) to the Customer within 30 days.
Article 9
Due to the nature of a second-hand vintage shop and due to the nature and age of the offered objects a lot of them are for sale for their collectionable and design value and not (anymore) for their state-of-the-art and technical functionalities; moreoever as their technology is mostly outdated at the moment of purchasing.
Objects who are sold solely for their non-technical and non-functional value are individually stated in their product description with the term “Collectable object”. Those objects do have their full lawfully guaranty, but are excluded from any technical or functional shortcommings and have their normal wear and tear given their age. Those objects must be bought exclusively for their intrinsic collectionable and design value and their hard to find importance.
The objects do function – unless otherwise stated, meaning that their lights, … became to life at the moment of testing after connecting to the current supply and did react normally to their basic functions. Due to their old status, being second hand and lack of precise user history it is very hard (and logically unpossible) for those specific objects to predict and to guarantee the perfect technical working condition of every aspect of the object for a certain duration and a certain number of connecting cycles.
It is widely known in the world of - for instance - jukeboxes, pinball or slot machines that one can not predict whether the object will function the next time it is started up, especially if it took a certain period before the object is restarted again. As a result, these original electromechanical machines are very popular mainly amonst true collectors for the pureness of their vintage look and play. They can provide true ‘vintage’ pleasure, nevertheless periodic maintenance and problems – particularly when not powered on regularly – shurely can be your part.
In the case of consumer goods and thus the Customer has the status of consumer, a legal guarantee of one year applies for second-hand products and two years for new products, if they are not described on our website as “Collectable”. In the latter case they are clearly and exclusively sold for their intrinsic collectionable and design value as above-mentioned.
Article 10
The possible nullity of one or more clauses in these conditions does not entail the nullity of the complete conditions.
On all agreements with Toys for Boys Brussels (Design Technics bv), Belgian law is solely applicable, with the exception of the Vienna Convention (C.I.S.G) or other international legal rulings of which omission is admissable. In case of dispute, only the competent courts of the judicial district of West Flanders, department Kortrijk, are competent.
